Dear Sir/Madam,
pursuant to Articles 13 and 14 of EU Regulation 2016/679 (hereinafter GDPR) regarding the provisions for the protection of individuals and other subjects with respect to the processing of personal data, the personal data provided will be processed in compliance with the aforementioned regulation and confidentiality obligations, the following information is provided:
THE DATA CONTROLLER
The data controller is BLU HOSPITALITY SRLS, with registered office at c.da Campo inferiore snc, 89861 Tropea (VV), VAT no. 03866480795 email: bluhospitalitysrls@gmail.com. The list of data processing officers is kept at the registered office of the Data Controller.
SUBJECT OF THE PROCESSING
The Data Controller collects and processes personal data (where personal data is understood as any information relating to an identifiable natural person) provided by you for the conclusion of service contracts. The data may be used for promotional and/or marketing purposes only with specific consent (Articles 23 and 130 of the Privacy Code and Article 7 GDPR).
The data processed are:
personal identification data (personal details, email address, residential address and phone number);
data relating to the stay;
identification documents;
credit card data or bank payment data;
billing address;
data relating to particular health conditions provided voluntarily, used exclusively for the provision of a specific service (for example in the case of specific dietary regimes);
in the case of subjects under 18 years of age, the data will be provided to the Data Controller only by those who exercise parental responsibility;
DATA COLLECTION METHODS
Personal data may be collected through:
activities related to the provision of hotel services (quotation, booking, check-in operations, service payment, complaint management);
promotional and/or marketing activities subject to specific consent (Articles 23 and 130 Privacy Code and Article 7 GDPR);
OTAs (Booking.com; Airbnb, Expedia), tour operators, travel agencies, etc…
connection to the website and completion of the contact request form;
associations, companies or individuals who organize stays or events at the facility.
PURPOSE OF THE PROCESSING
For data processing, this means any operation or set of operations, carried out with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of making available, alignment or combination, restriction, erasure or destruction.
The data you provide will be used for the following purposes:
subscription and provision of the requested service;
fulfillment of legal obligations;
administrative and accounting purposes;
customer care;
promotion and/or marketing activities with prior consent;
litigation management.
For the aforementioned purposes, the processing is necessary for the execution of the requested services and the obligations undertaken by Blu Hospitality srls and is carried out in compliance with applicable legal regulations or following requests from the competent Authorities.
CONSEQUENCES OF FAILURE TO PROVIDE PERSONAL DATA
Failure to provide personal data may prevent the Data Controller from providing the services, as they are necessary for the execution of the contract or the requested service. However, the provision of the service is not prevented if you have not freely given your consent for the additional specific purposes indicated above.
PROCESSING METHODS
The processing will be carried out in such a way as to guarantee the security of the data itself, in order to prevent data loss, unauthorized modification and disclosure, and unauthorized access to the data through paper, electronic or telematic means for the purposes mentioned above. Personal data may be processed by collaborators of the Data Controller, appointed to carry out specific operations necessary for the pursuit of the aforementioned purposes.
DATA RETENTION
The data will be kept for the time necessary to execute the contract or requested service and subsequently for the period strictly necessary to fulfill retention obligations for tax purposes or for other purposes provided for by legal regulations applicable to the Data Controller and for the possible protection of its rights and interests or those of third parties. The data collected for the specific purposes indicated above will be processed for the following 24 months from collection.
RIGHTS OF THE DATA SUBJECT
At any time you may exercise your rights pursuant to Articles 7, 15, 16, 17, 18, 21 of the GDPR. In particular, you can:
a) have access to your personal data (art. 15)
b) obtain information about the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be disclosed, and, when possible, the retention period;
c) obtain the rectification, integration, and deletion of data "right to be forgotten" (arts. 16 and 17)
d) obtain the restriction of processing (art. 18);
e) obtain data portability, that is, receive them from a data controller in a structured, commonly used and machine-readable format, and transmit them to another data controller without hindrance (art. 20);
f) object to the processing at any time, including in the case of processing for direct marketing purposes (art. 21);
g) to object to automated decision-making relating to individuals, including profiling.
i) withdraw consent at any time, limited to cases where the processing is based on your consent for one or more specific purposes and concerns ordinary personal data (for example, date and place of birth or place of residence), or special categories of data (for example, data revealing your racial origin, political opinions, religious beliefs, health status, or sexual life). Processing based on consent and carried out prior to its withdrawal remains, in any case, lawful; (art. 7, paragraph 3 and 13, paragraph 2, letter c)).
j) lodge a complaint with a supervisory authority.
